Qube Net Terms and Conditions

  1. Service Provider: Qube Net (Mousim M Fatwani) (“Service Provider”), 001 C-8 Sector 8 Shanti Nagar Mira Road East Thane Maharashtra 401107, Direct or through its franchisee under license granted by the Government of India.
  2. Service Provider’s Obligations: The Service Provider agrees to provide the services to the Customer on the terms and conditions mentioned in this Customer Application Form (“CAF”).
  3. Service entitlements: Service entitlements of the Customer under the chosen Tariff Plan will be applicable as per the Tariff Plan prescribed from time to time.
  4. Change in Tariff Plan: The customer is not permitted to change the tariff plan in the middle of his usage cycle or until the validity period expires. However, the plan can be upgraded by paying the differential amount of the higher plan for the residual term of the existing plan on a pro-rata basis.
  5. The Service shall run throughout the entire term of the plan selected by the customer and the customer shall not be entitled to ask for suspension of service for any part of the term.
  6. Login ID and Password: The Service Provider shall provide a Login ID and Password to every customer to access broadband services.
  7. Customer’s Obligations: The customer shall:
    1. Be responsible for providing PC/TV with the right configuration to suit the requirements of the service opted for.
    2. Not use any hardware or software declared by the Government as unlawful or affecting the network security.
    3. Not resell or redistribute the Services to any other person or party in any manner, as the Service is provided to the customer for his own use only.
    4. Ensure that all dues to The Service Provider are paid in time.
    5. Provide correct KYC documents and register their email ID and cell number with the Service Provider, and any changes thereto from time to time.
    6. Not reproduce, distribute, publish, copy, download or otherwise exploit any third-party content protected by copyright or other intellectual property rights unless they own the relevant rights or have obtained all the requisite licenses and approvals.
  8. The Customer authorizes the Service Provider to access, copy, amend or delete any third-party content uploaded or otherwise provided by the customer through the use of Services, where any such third-party content is or alleged to be defamatory, in breach of copyright, illegal, or otherwise inappropriate in the sole opinion of the Service Provider.
  9. Customer is required to ensure that no objectionable or obscene messages, communications, or material are generated/sent by the customer, which are in derogation of established laws of the Country.
  10. Sending of Promotional SMS: Customer hereby permits the Service Provider to send service-related, informative, or promotional SMS.
  11. Payments and Billing:
    1. The period of Service is considered from the date of activation. In case of recharging, the validity period will be considered from the date of recharge.
    2. Customer can recharge the services account using available payment modes.
    3. Recharge of the account needs to be done prior to the end of the current validity period.
    4. All payments are to be made in favor of ‘Qube Net (Mousim M Fatwani)’ by cheque, demand draft, or via the Payment Gateway provided at the website qubenet.in.
  12. If the customer’s service is suspended or terminated due to default or violation of these terms, the Service Provider will consider reconnection on examination of the case and will levy appropriate reconnection charges.
  13. At initial installation, the customer is liable to pay one-time non-refundable installation charges as per the tariff plan. Re-location charges apply for a change of address within the network coverage of the Service Provider.
  14. Child Safe Mode: The customer assumes responsibility for the use of the Service by any person under 18 years of age and will provide appropriate supervision.
  15. Network Security: Any information sent by the customer over the network is at their own risk. The customer's internal network security is their sole responsibility.
  16. Access to Customer’s Premises: Customer authorizes the Service Provider and its representatives to enter premises to install, maintain, inspect, repair, and remove equipment.
  17. Disclaimers:
    • The Service Provider takes no responsibility for content accessed by the customer.
    • The Service Provider will endeavor to maintain service quality but is not liable for disruptions due to external factors.
    • The Service Provider makes no warranties on the Services provided, including interruptions or viruses.
  18. Right to Confirmation: The Service Provider reserves the right to verify the information provided by the Customer.
  19. Theft of Service: Unauthorized receipt of the Service constitutes theft of service, in violation of the laws of the Land.
  20. Termination of Service: The Service Provider retains the right to withdraw or terminate the Service without notice in cases of wrongful representation or non-payment of dues.
  21. Internet equipment provided is exclusive property of the Service Provider and must be returned in working condition on disconnection of services.
  22. The Service Provider reserves the right to suspend the Services for maintenance with prior notice.
  23. The Service Provider will not be responsible for the return of customer data upon termination of services.
  24. Termination of Service by Customer: Must be communicated to the SERVICE PROVIDER and is effective after payment of all outstanding dues.
  25. Terms of Services are subject to government regulations.
  26. Waiver: Failure to enforce any provision does not constitute a waiver of that provision.
  27. Limited Liability: The Service Provider accepts no liability for commercial transactions entered over the Internet by the Customer.
  28. Encryption: The customer must not adopt any measures that hinder the Service Provider from maintaining logs.
  29. Indemnification: Customer will be responsible for any use of their account and indemnifies the Service Provider for any claims arising from it.
  30. Force Majeure: The Service Provider is not liable for failure due to uncontrollable events.
  31. CIBIL DISCLOSURE: Customer consents to the disclosure of information to CIBIL as necessary.
  32. Arbitration: Disputes will be referred to arbitration governed by Indian Arbitration Law.
  33. Governing Laws and Jurisdiction: Governed by Indian laws, with exclusive jurisdiction in Mumbai.

I agree to abide by the terms and conditions of provision of service as amended from time to time. I hereby declare and confirm that the information provided by me is correct, complete and true in every respect.”
